General terms and conditions
Updated: 5 October 2026
1. Provider and scope
These conditions apply to agreed consulting, coaching and training services provided by Yilmaz Ertaş, McErtas Business Solutions, Weberstraße 22, 95028 Hof. Services include start-up and business consulting, business and financial planning, sales coaching and training. The terms become part of a contract only if we draw attention to them before conclusion, provide an opportunity to read them and their application is agreed. Individual agreements take precedence.
Clients may be businesses or consumers. The purpose of the particular transaction determines their status; the label “founder” or “self-employed” alone does not determine consumer status. Funded programmes or contracts with a training provider are subject to their separate contractual and funding conditions. These terms do not create a self-payment obligation for funded participants.
2. Enquiry and contract conclusion
The website invites enquiries. Contacting us or booking an orientation meeting labelled as free does not conclude paid coaching. A paid contract is formed through a specific offer and its acceptance, for example by email. Scope, total price, payment conditions, duration and delivery are communicated beforehand. An automatic appointment confirmation alone does not replace this agreement. The contractual language is German. Offers, acceptance and agreed terms are provided in a form you can save.
3. Content and limits of services
The offer specifies the number and duration of appointments, individual or group format, location or online delivery, materials, feedback and any tasks between sessions. Additional services, expenses and travel require prior agreement. There is no automatic renewal or automatic purchase of a larger package.
Coaching supports your decisions and implementation. It does not include legal or tax advice or medical treatment. No particular revenue, percentage revenue increase, customer count or funding approval is guaranteed. Goals and calculation examples are not success promises. Expressly agreed characteristics or specific deliverables and the statutory rights applicable to them remain unaffected.
4. Cooperation and delivery
Provide the information needed for the assignment in good time and to the best of your knowledge, attend agreed appointments and decide independently how to implement advice. Online sessions require a suitable device and internet access; the communication service is agreed beforehand. We discuss delays and their consequences. They do not automatically forfeit your rights or all appointments. Report document errors promptly. There is no rigid deadline excluding complaints.
5. Appointments, cancellation and absence
Please request cancellation or rescheduling by email as early as possible. We arrange a replacement date. These terms impose no flat cancellation fee. Any statutory remuneration or damages claim depends on the individual case; saved expenses and other earnings must be credited to the extent required by law. Statutory termination and withdrawal rights remain unaffected.
If the coach is unavailable, we offer a replacement appointment. If the agreed service cannot be delivered, advance payments for that part are refunded. Further statutory claims remain unaffected. A free orientation meeting does not incur a no-show fee.
6. Prices and payment
The price agreed before contract conclusion applies, in euros. Consumers receive the total price including applicable taxes and agreed incidental costs. Net offers expressly addressed to businesses show any additional VAT. Tax exemption is stated only where it actually applies. Instalments, advances and due dates are specified in the offer; instalments do not change the overall scope. Additional services are charged only by agreement. Statutory rules apply to late payment. Statutory set-off and retention rights remain.
7. Confidentiality, materials and recordings
Confidential business and personal information is not disclosed without authorisation. Statutory disclosure duties remain. You may use materials for the agreed work and within your commissioning business and make necessary working copies. Selling, publishing or sharing outside this scope requires permission. Statutory usage rights remain. Recording conversations or publishing names, images and testimonials requires separate consent from the people concerned.
8. Duration and termination
The contract ends once agreed services are delivered or the individually agreed term expires. There is no automatic renewal. Termination may be declared in text form, particularly by email. Statutory termination rights, including section 627 BGB where applicable and termination for good cause, remain unaffected. Payment and refunds on early termination follow the agreement and mandatory law. Amounts already paid are not automatically forfeited.
9. Liability and rights
Our liability and your claims arising from breaches of duty follow statutory law. These terms contain no blanket exclusion of liability for minor negligence, injury to life, body or health, or breach of essential contractual obligations. Your responsibility for business decisions does not restrict statutory claims for defective services.
10. Privacy and consumer withdrawal
Personal data processing is explained in the privacy notice. Consumers concluding distance or off-premises service contracts should refer to the separate withdrawal information. Businesses do not have the statutory consumer withdrawal right. Starting coaching early does not automatically remove this right.
11. Law and jurisdiction
German law applies. Consumers retain the mandatory protection of the law of their country of habitual residence. Statutory jurisdictions apply to consumers. Exclusive jurisdiction in Hof is agreed only for merchants, public-law legal entities and public-law special funds, where legally permitted. If a provision is invalid, statutory rules apply.
Withdrawal information for services
Updated: 5 October 2026
This information applies to consumers concluding service contracts at a distance or outside our business premises.
Right of withdrawal
You may withdraw from the contract within fourteen days without giving a reason. The withdrawal period is fourteen days from the date the contract is concluded.
Notify Yilmaz Ertaş – McErtas Business Solutions, Weberstraße 22, 95028 Hof, Germany, email: info@mcertas.com, telephone: +49 1514 1292872, of your decision by an unambiguous statement, for example by email or letter. The model form below is optional. To meet the deadline, send your withdrawal statement before the period expires.
Effects of withdrawal
Following withdrawal we refund all payments received, including any standard delivery costs, without undue delay and no later than fourteen days after receiving the withdrawal. Extra costs of a more expensive delivery method chosen by you are excluded. We use the original payment method unless expressly agreed otherwise. No refund fees are charged.
If you expressly requested that services begin during the withdrawal period, and the statutory requirements are met, you pay a reasonable amount for the portion delivered up to notification of withdrawal in proportion to the agreed overall scope.
Full performance within the withdrawal period
For paid services, the withdrawal right expires only on full performance if, before services begin, you expressly consented to an early start and acknowledged that you would lose your withdrawal right on full performance. For off-premises contracts this consent must be on a durable medium. A single appointment or merely agreeing an early start is not automatically sufficient.

Yilmaz Ertaş – McErtas Business Solutions, Weberstraße 22, 95028 Hof, Germany. Email: info@mcertas.com, telephone: +49 1514 1292872. These notices cover this website, contacting us and data processing for consulting. Other technical versions or external platforms may involve additional processing.
2. Delivery and hosting
This version is delivered through OpenAI Sites using Cloudflare infrastructure. Connection and device data are processed, including IP address, time, requested address, browser information, any referrer and technical error data. This serves delivery, security and troubleshooting. Our processing is based on Art. 6(1)(f) GDPR, with a legitimate interest in a secure, accessible online service.
Technical recipients include OpenAI and its infrastructure providers, particularly Cloudflare. Their additional platform notices apply: OpenAI privacy and Cloudflare privacy. We do not manage platform logs ourselves and do not promise an unverified deletion period.
3. Contact and consulting
When you contact us by email or telephone, we process contact details and message content. Requested or agreed services rely on Art. 6(1)(b) GDPR; other enquiries on Art. 6(1)(f), our legitimate interest in responding. Coaching involves necessary contract, appointment, invoice and consulting data you provide. Statutory recordkeeping and retention obligations rely on Art. 6(1)(c) GDPR.
Do not send unnecessary sensitive data; anonymise customer data for exercises where possible. Health data and other special categories are not required for a general enquiry. Contacting us is not blanket consent to advertising. Marketing requires a separate legal basis. Consent may be withdrawn at any time with future effect.
4. Appointments through Zeeg
Our appointment links open an external service of Zeeg GmbH, Friedrichstraße 155, 10117 Berlin. No Zeeg widget is embedded here; a connection is established only when you open the link. Booking data, such as name, email, chosen appointment and optional information, is processed for scheduling and communication. Our appointment management relies on Art. 6(1)(b) GDPR, general enquiries on Art. 6(1)(f). You may alternatively arrange an appointment by email or telephone. Details: Zeeg privacy notice.
5. WhatsApp and appointment coordination
If you expressly select WhatsApp appointment coordination and send the enquiry, we use your mobile number on the basis of consent (Art. 6(1)(a) GDPR) to propose or coordinate appointments through that channel. The assigned team processes the necessary contact and appointment data. Consent is voluntary, covers no advertising, and can be withdrawn at any time with future effect by email to info@mcertas.com. Without consent we coordinate by email. The Zeeg information also applies to Zeeg bookings.
The WhatsApp link opens an external service; no WhatsApp plugin is embedded here. When you use this channel, we process phone number, name, messages and any attachments to handle your enquiry under Art. 6(1)(b) or (f) GDPR. WhatsApp Ireland Limited additionally processes usage and communication data under its own terms, possibly involving recipients outside the EEA. Message encryption does not prevent all metadata processing. You can alternatively reach us by email or telephone. Details: WhatsApp privacy.
6. Enquiry process and tracking
Enquiry data is initially processed only in your browser to prepare an email draft containing name, email, mobile number, situation, appointment request and optional WhatsApp choice. This form does not send it to us or store it persistently in the page. We receive it only when you send the email. Copying places the text on your clipboard. Do not submit unnecessary sensitive data. The cookie banner stores only your privacy choices. Google Analytics and Meta Pixel are not currently active. Images are served from local website files and fonts use system fonts. No video or map widgets are embedded.
7. Recipients and transfers
Necessary data may reach the technical providers used for the stated purposes and authorised recipients for billing and statutory duties. This website does not automatically send data to advertising networks. For external services, also consult their linked notices. Processing outside the EEA is subject to Art. 44 et seq. GDPR. You can ask us about specific recipients, safeguards and agreements relevant to your case.
8. Retention and provision of data
Enquiries are deleted once fully handled and no further legal basis for retention exists. Contract and invoice data follows applicable statutory retention periods. Evidence for legal claims is retained until the purpose ends, then deleted or anonymised. Platform services also have their own retention rules. Without required contact or contract data we may be unable to handle an enquiry or deliver agreed services. Additional information is voluntary.
9. Rights and complaints
Subject to statutory requirements, you have rights of access, rectification, erasure, restriction and portability (Art. 15–20 GDPR). You may withdraw consent at any time with future effect; lawful processing before withdrawal remains unaffected.
Objection: You may object to processing under Art. 6(1)(f) GDPR for reasons relating to your particular situation. You may object to direct marketing at any time, including related profiling. Contact info@mcertas.com.
You may complain to a supervisory authority, particularly where you live, work or suspect a breach. The Bavarian State Office for Data Protection Supervision is a contact for our private business in Bavaria. This website does not make automated decisions with legal or similarly significant effects.
